1. Scope
The following General Terms and Conditions (hereinafter "GTC") apply to all orders placed via our online shop at www.vonzweiterhand.ch (hereinafter "Online Shop"). The offer is directed at individuals residing or legal entities based in Switzerland or abroad (hereinafter "Customer").
The Online Shop reserves the right to amend these GTC at any time. The version of these GTC applicable at the time of the order is binding and cannot be unilaterally amended for that order. Customer terms and conditions that conflict with or deviate from these GTC will not be recognized.
The Online Shop is operated by vonzweiterhand GmbH (Imprint).
2. Information in this Online Shop
The Online Shop contains information about products. Price and assortment changes as well as technical modifications are reserved. All details in the Online Shop (product descriptions, images, illustrations, videos, measurements, weights, technical specifications, accessory relationships, and other information) serve as illustrations and are approximate values; they are non-binding. They do not constitute assurances of properties or warranties unless explicitly stated otherwise. The Online Shop strives to provide all information and details in the Online Shop accurately, fully, up-to-date, and clearly, but the Online Shop cannot provide any express or implied warranty for this.
All offers in this Online Shop are non-binding and should not be understood as binding offers.
The Online Shop cannot guarantee that the products listed will be available at the time of order. Therefore, all information regarding availability and delivery times is without guarantee and may change at any time without notice.
3. Prices
The prices indicated in the Online Shop are in Swiss Francs (CHF) and include value-added tax (VAT). The price in the order confirmation is binding.
Technical changes and errors are reserved, particularly the right to change prices at any time and without prior notice.
4. Conclusion of Contract
The products and prices in this Online Shop are considered non-binding offers.
By ordering through this Online Shop, including acceptance of these GTC, the Customer submits a legally binding offer to conclude a contract. The Online Shop then sends an automatic order confirmation by email, confirming that the Customer’s offer has been received. Orders placed are binding for the Customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as the Online Shop sends an acceptance declaration by email, confirming the dispatch of the ordered products.
Orders are only delivered after full payment has been received (exception: delivery on invoice) and if the goods are available. If the ordered goods cannot be delivered in full, the Online Shop is entitled to accept or execute the order partially or not at all. In such cases, the Online Shop will inform the Customer by email. If the Customer has already made a payment, it will be refunded to the Customer. If no payment has been made, the Customer will be released from payment obligations.
5. Payment Options and Retention of Title
The Customer has access to the payment options specified during the order process. Payments must be made in Swiss Francs.
The Online Shop reserves the right to exclude Customers from specific payment methods without reason or to require advance payment.
The Online Shop may charge the Customer interest on arrears at 5% per year for payment delays, plus a maximum reminder fee of CHF 20 per reminder.
Products delivered to the Customer remain the property of the Online Shop until full payment is received.
6. Delivery, Duty to Inspect, Notification of Defects, and Return
Deliveries are sent via Swiss Post AG to the address provided by the Customer in the order. No deliveries are made on official national or cantonal holidays.
Shipping costs depend on the weight and size of the ordered products. They are charged additionally and are to be paid by the Customer. The shipping costs are listed separately on the invoice. The shipping costs communicated in the Online Shop apply.
The Online Shop strives to keep delivery times as short as possible. However, any delivery times specified in the order confirmation are non-binding. The Online Shop is entitled to make partial deliveries, and shipping costs will only be charged once to the Customer. If the delivery has already been dispatched and the Customer still withdraws from the purchase contract, all shipping costs are to be borne by the Customer.
Invoices, if delivery on account is offered, will be sent at the discretion of the Online Shop via email or post.
If the delivery is undeliverable or the Customer refuses to accept the delivery, the Online Shop may dissolve the contract after notifying the Customer by email and granting a reasonable grace period, charging the Customer for any costs incurred.
Complaints regarding delivery volume, product defects, incorrect deliveries, and quantity discrepancies must be made in writing immediately, but no later than within 14 days of receipt of the goods, to the extent that they are identifiable by reasonable examination. Exchanges or returns are only processed for justified complaints or by personal arrangement.
Please note: Before returning goods, please request an RMA number (Return Merchandise Authorization) by email. Unfortunately, we cannot process returns without an RMA number. In the case of a return, the original shipping costs are to be fully borne by the Customer.
Returns to the Online Shop are at the Customer's expense and risk. The Customer must send the goods in their original packaging, complete with all accessories, along with the delivery note and a detailed description of the defects to the return address provided by the Online Shop.
If inspection by the Online Shop reveals that the goods do not have identifiable defects or are not covered by the manufacturer’s warranty, the Online Shop may charge the Customer for any expenses, return shipping, or disposal costs.
7. Right of Return
If you are dissatisfied with the delivery or specific items, you have the right to return the entire shipment or individual items within 5 days. Returns are only accepted under the following conditions: items must be in flawless and original packaging. Items must not be defective or used unless they arrived defective or partially defective. If the delivery was defective, the delivering company (Swiss Post) must be notified immediately. Return shipping must be sufficiently prepaid. We may charge you for defective, damaged, and incomplete returns.

8. Warranty
The Online Shop strives to deliver products of impeccable quality. For defects reported in a timely manner, the Online Shop assumes a two-year warranty period from the date of delivery for the purchased item’s freedom from defects and functionality. It is at the Online Shop’s discretion to fulfill the warranty through free repair, equivalent replacement, or refund of the purchase price. Additional warranty rights are excluded.
The warranty does not cover normal wear and tear or damage caused by improper handling or damage by the Customer or third parties, nor defects resulting from external circumstances. The warranty is also excluded for consumable and wear parts (e.g., batteries, rechargeable batteries, etc.).
The Online Shop cannot guarantee the accuracy, completeness, and timeliness of the information and data provided or the uninterrupted availability of the Online Shop, its features, integrated hyperlinks, and other content. In particular, there is no assurance or guarantee that the use of the Online Shop does not infringe on third-party rights not owned by the Online Shop.
9. Liability
The Online Shop excludes all liability, regardless of the legal basis, as well as claims for damages against the Online Shop and any auxiliary persons or agents. The Online Shop is not liable for indirect damage, consequential damage, lost profits, or other personal, property, and pure economic damage of the Customer. Further mandatory legal liability, for example, for gross negligence or illegal intent, remains reserved.
The Online Shop uses hyperlinks solely to simplify Customer access to other websites. The Online Shop cannot know the content of these websites in detail, nor does it accept liability or any other responsibility for the content of these websites.
10. Data Protection
The Online Shop may process and use data collected during the contract conclusion to fulfill obligations from the purchase contract. The necessary data for performance fulfillment may also be transferred to commissioned service partners (logistics partners) or other third parties.
The Privacy Policy is an integral part of these GTC. By accepting these GTC, you also agree to the Privacy Policy.
11. Partial Invalidity
Should individual provisions of these GTC be or become invalid or unenforceable, this does not affect the validity of the remaining provisions.
12. Contract Termination Clause
If the Customer fails to meet any of their obligations, partially fulfills them, or misses a payment deadline, the Online Shop reserves the right to demand immediate payment of all outstanding amounts, suspend all deliveries, or terminate the existing contract.
13. Additional Provisions
The Online Shop expressly reserves the right to amend these GTC at any time and to put them into effect without notice.
In the event of disputes, only substantive Swiss law, excluding conflict-of-law norms, shall apply. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded.
The exclusive place of jurisdiction is Chur.
