The following general terms and conditions (hereinafter "GTC") apply to all orders placed via our online shop www.vonzweiterhand.ch (hereinafter "online shop"). The offer is aimed at natural persons residing or legal entities based in Switzerland or abroad (hereinafter "customer").

The online shop reserves the right to change these terms and conditions at any time. The version of these terms and conditions valid at the time of the order is decisive and cannot be changed unilaterally for this order. Customer conditions that conflict with or deviate from these terms and conditions will not be recognized.

The online shop is operated by the company vonzweiterhand GmbH (Imprint).

The prices stated in the online shop are in Swiss francs (CHF), including value added tax (VAT). The price in the order confirmation is decisive.

By placing an order via this online shop, including acceptance of these terms and conditions, the customer makes a legally binding offer to conclude a contract. The online shop then sends an automatic order confirmation by email, which confirms that the customer's offer has been received by the online shop. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is concluded as soon as the online shop sends a declaration of acceptance by email, confirming the dispatch of the ordered products.

Orders will only be delivered after full payment has been received (exception: delivery against invoice) and provided the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, the online shop is entitled not to accept or execute the order or to only accept it in part. In such a case, the online shop will inform the customer by email. If the customer's payment has already been received by the online shop, the payment will be refunded to the customer. If no payment has yet been made, the customer is released from the obligation to pay.

  1. Payment options and retention of title

The customer can choose from the payment options specified during the ordering process. Payments must be made in Swiss francs.

The online shop reserves the right to exclude customers from certain payment options or to insist on payment in advance without giving reasons.

If the customer defaults on payment, the online shop may charge interest on arrears of 5% per year and a reminder fee of a maximum of CHF 20 per reminder.

The products delivered to the customer remain the property of the online shop until full payment has been made.

  1. Delivery, obligation to inspect, notification of defects and return

Deliveries are sent by Swiss Post AG to the address provided by the customer in the order. No deliveries are made on official national or cantonal holidays.

The shipping costs depend on the weight and size of the products ordered. They are charged additionally and are to be paid by the customer. The shipping costs are listed separately on the invoice. The shipping costs communicated in the online shop apply.

The online shop endeavours to keep delivery times as short as possible. However, any delivery times stated in the order confirmation are non-binding. The online shop is entitled to make partial deliveries. In this case, the customer will only be charged for shipping costs once. If the delivery has already been sent and the customer still withdraws from the purchase contract, all delivery costs must be borne by the customer.

The invoice will be sent, if delivery against invoice is offered, by email or post at the online shop's discretion.

If the delivery cannot be made or if the customer refuses to accept the delivery, the online shop can terminate the contract after notifying the customer by email and observing a reasonable grace period and invoice the costs for the effort.

Complaints regarding the scope of delivery, material defects, incorrect deliveries and quantity discrepancies must be made in writing immediately, but no later than 14 days after receipt of the goods, provided that these can be determined through reasonable investigations. Goods will only be exchanged or returned if the complaint is justified or by personal agreement.

Please note: Before returning the goods, please request an RMA number (return number) by email from Email address . Unfortunately, we cannot accept returns without the RMA number. Our original shipping costs in the event of a return of the goods must be borne in full by the customer.

Returns to the online shop are at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address specified by the online shop.

If the online shop's inspection reveals that the goods do not have any detectable defects or that they are not covered by the manufacturer's warranty, the online shop can charge the customer for the costs of returning the goods or any disposal.

  1. right of return

If you are not satisfied with the delivery or individual items of the delivery, you have the right to return the entire shipment or individual items of the shipment within 5 days. The items or shipments can only be returned under the following conditions: The items must be in perfect condition and in their original packaging. The "vzh" tag must still be on the bag. The items must not be defective or in a used condition, unless individual items or the entire delivery were delivered to you defective or partially defective. In the event of a defective delivery, the delivering company (The Post) must be notified immediately. The return shipment must be sufficiently stamped. We must invoice you for defective, damaged and incomplete returns.

  1. warranty

The online shop endeavours to deliver goods of impeccable quality. In the case of defects reported in a timely manner, the online shop guarantees that the item purchased by the customer is free of defects and functional during the statutory warranty period of two years from the delivery date. It is at the discretion of the online shop to provide the guarantee through free repair, equivalent replacement or by refunding the purchase price. Other warranty rights are excluded.

The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects that are due to external circumstances. The warranty also does not cover consumables and wearing parts (e.g. batteries, rechargeable batteries, etc.).

The online shop is unable to provide any assurances or guarantees that the data is up-to-date, complete and correct, or that the online shop, its functionalities, integrated hyperlinks and other content will be available at all times or without interruption. In particular, it is neither assured nor guaranteed that the use of the online shop will not infringe the rights of third parties who are not owned by the online shop.

  1. Liability

The online shop excludes any liability, regardless of its legal basis, as well as claims for damages against the online shop and against any auxiliary persons and vicarious agents. In particular, the online shop is not liable for indirect damage and consequential damage, lost profits or other personal, material and purely financial damage to the customer. Further mandatory legal liability, for example for gross negligence or unlawful intent, remains reserved.

The online shop uses hyperlinks only to simplify the customer's access to other web offers. The online shop cannot know the content of these web offers in detail, nor can it accept liability or other responsibility for the content of these websites.

The online shop may process and use the data recorded during the conclusion of the contract to fulfill the obligations arising from the purchase contract. The data necessary to fulfill the service may also be passed on to commissioned service partners (logistics partners) or other third parties.

The online shop expressly reserves the right to change these General Terms and Conditions at any time and to put them into effect without notice.

In the event of disputes, Swiss substantive law shall apply exclusively, excluding conflict of law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The exclusive place of jurisdiction is Chur.
